Behested Payment Reports (Form 803)

Purpose, Information and Related Materials

Pursuant to the Fair Political Practices Commission (FPPC), a behested payment is when a state or local elected official solicits a donation to an organization, such as 501(c)(3), that is used for legislative, governmental or charitable purposes.  These type of payments are not considered campaign contributions or gifts.  While state law limits the amount of campaign contributions and gifts, there are no limits on behested payments.  State law requires the reporting on behested payments if they total $5,000 or more per calendar year from a single source.  Officials must report the behested payments within 30 days of the date they are made.

In accordance with 18944.2, subsection (C)(3)(F), “the filing officer shall post a copy of the form on the agency’s website.”  In addition to the forms posted on the internet, hard copy/printed versions of the forms may be requested from the City Clerk’s Office located at City Hall.
